1.3     Personal data means any information relating to you as a natural person, e.g. name, address, email addresses, or information about your use of our website (see also below, para. 2).          
Processing means any operation that is performed in connection with personal data. Processing is, for example, the gathering, collection, organisation, arrangement, storage, adaptation or modification, reading, querying, use, disclosure by transmission, dissemination or any other form of provision, comparison or linking, restriction, deletion or destruction of personal data.

2.1.1  Informational use of our website

When using our website for information purposes only, i.e. if you do not register or otherwise provide us with information, we only collect the personal data that your browser transmits to our server. If you want to look at our website, we collect the following data:

- time zone difference from Greenwich Mean Time (GMT)
- content of the request (specific webpage),
- access status/HTTP status code,
- volume of data transferred in each case,

Purpose and legal basis
The purpose of our processing of these data is to display our website on your device and to ensure stability and security. The legal basis is Article 6(1)(f) GDPR. According to this provision, the processing of personal data is lawful to protect our legitimate interests, unless the interests or basic rights and liberties of the data subject prevail.
These personal data are stored only for the duration of your visit to our website.


 2.1.2 Contact by email or the contact from on our website

When you contact us by email or via a contact form, the data you provide (your email address, and if applicable your name and your telephone number) will be stored by us in order to answer your questions. We will delete the data collected in this context after their storage is no longer required, or otherwise limit their further processing if we are required by law to retain them. The legal basis for this processing is Article 6(1)(f) GDPR, except if statutory retention obligations apply; in this case the legal basis for the storage of the data is Article 6(1)(c) GDPR; according to this provision, the processing is lawful if it is necessary for compliance with a legal obligation.

a)  In addition to the aforementioned data, cookies are stored on your computer when you use our website. Cookies are small text files that are stored on your hard disk allocated by the browser you are using and by which the body which sets the cookie (in this case, us), receives certain information. Cookies cannot run programs nor deliver viruses to your computer. They serve to make the internet offer overall more user-friendly and effective. The legal basis for this processing is your consent - which can be revoked at any time - pursuant to Article 6(1)(a) GDPR, which give you at the beginning of your visit to our website, or pursuant to Article 6(1)(f) GDPR.

a)  This website uses Google Analytics, a web analysis service provided by Google Inc. ("Google"). Google Analytics uses so-called "cookies", text files which are stored on your computer and which allow an analysis of your use of the website. The information gathered by the cookie about your use of this website is generally transmitted to a server in the USA and stored there. If IP anonymisation is activated on this website, your IP address will first be truncated by Google within a Member State of the European Union or other Contracting Party of the Agreement on the European Economic Area. The whole IP address will be first transferred to a Google server in the USA and truncated there only in exceptional cases. e)    We use Google Analytics to analyse and regularly improve the use of our website. and make it more interesting for you as a user. The legal bases for the use of Google Analytics is Article 6(1)(f) GDPR.

a)  We have included YouTube videos in our online offering, which are stored on www.YouTube.com and are directly playable directly from our website. 

b)    When you visit this website, YouTube receives the information that you have accessed the corresponding subpage of our website. In addition, the data mentioned under para. 2.1.1 of this Policy will be transmitted. This takes place regardless of whether YouTube makes available a user account via which you are logged in or no user account exists. If you are logged in to Google, your information will be directly associated with your account. If you do not wish to be associated with your profile when using YouTube, you must first log out before clicking the button. YouTube stores your data as usage profiles and uses them for the purposes of advertising, market research and/or requirements-oriented design of its website. Such evaluation also takes place (even for users who are not logged in) for the purposes of providing customised advertising and to inform other social network users about activities on our website. a)     On this website, we use Google Maps. This allows us to display for your benefit interactive maps directly as part of a webpage and allows you convenient use of the mapping feature.

2.2    Applicant data

2.2.1 We process the following data of people, who contact us to apply for a position using the application form on our website or otherwise:

First name, last name, email address, address, telephone number (if specified) and the application data submitted to us.

2.2.2 Subject to an expressly declared consent, we will process the data only to carry out the application process on which the specific job application is based; without consent, we will not store the data after completion of the application process and any applicable storage periods.

2.3    Processing of personal data of customers, suppliers, visitors and other communication partners

2.3.1 We process the following data of our contacts at customers, suppliers, of visitors to our corporate premises and site and of other communication partners (hereinafter also jointly referred to as "data subjects"):

- form of address, first name and last name, position in the company or public authority where the data
subject is employed
- business of official communication data, consisting of the address, telephone number (landline/mobile
phone) and email address,
- all information that is required to process the communication concerned, in particular project or
contract data (especially in case of customers and suppliers), emails, appointments and meeting
results,
- of visitors: the date and time of an appointment, the visitor's contact person in our company.

2.3.2  We process the data pursuant to section 2.3.1 for the following purposes and based on the following legal bases:

- of contacts of customers and suppliers: to maintain reliable communications with our customers and
suppliers during the performance our contracts and (of customers) to provide information about the 
services of our company (advertising),
- of visitors: to facilitate a visit and exercise our right to reserve access to our premises 
[Hausrecht] in
theinterest of the safety of our company,
- of all other communication requested in each case by the data subject.

In all cases, the legal basis is Article 6(1) (f) GDPR.

If no permanent contractual or other legal relations are maintained with the company and/or the public authority where the data subject is employed, the latter's personal data will be processed or stored only for the purpose of completing the specific assignment in question.

2.3.3  In addition, we will process personal data of our customers and/or their contacts (name, first name, company) also to meet our obligations under public law vis-à-vis the public authorities, e.g. in connection with fiscal and commercial documentations as well as for export control purposes. The legal basis in this regard is Article 6(1) (c) GDPR.

2.4 Video surveillance

2.4.1  The access roads on the outside premises of our company site are under permanent video surveillance.

On the inside of our premises, video cameras are installed in the production hall, which produce recordings only outside working hours.

2.4.2  The purposes of the video surveillance are:

- protection against criminal acts and damage,
- general public and operational safety at the compamy premises,
- exercise of our right to reserve access to out premises 
[Hausrecht].

The legal basis for the data processing in this regard is Article 6(1) (f) GDPR. In terms of this provision, personal data may be processed if so required to protect our legitimate interests, unless the interests or fundamental rights and freedoms of the data subject prevail. Our legitimate interests regarding video surveillance are the protection of our company and our employees and the exercise of our right to reserve access to our premises [Hausrecht].

 

2.4.3  We will analyse stored video recordings only in connection with specific events, in other words, when we become aware of facts that require an examination of the recordings for a purpose in accordance with section 2.4.2. All stored video recordings are protected by a two-key system, so that access to the recordings requires authorisation from both key holders. The recordings will be stored for a period of no more than 4 weeks.

3.      Transmission of your data to third parties

In principle, we do not transfer your personal data to third parties without your consent.

Sometimes we rely on the support of third parties in connection with electronic data processing. They are reliable service providers, whom we have carefully selected to process your data in accordance with our mandate. The legal basis for this processing is Article 28 GDPR, Our service providers are of course obliged to handle the data carefully, strictly only in accordance with our instructions and in accordance with the applicable data protection provisions; they are especially not permitted to use the data for their own purposes to use, nor may they transmit them to third parties. 

In addition, in individual instances we may be required by law to transmit your data at the instruction of a public authority, if and to the extent that this is necessary for purposes of law enforcement or public safety by the police or other authorities. The legal basis for the transmission in these cases is Article 6(1)(c) GDPR.
Finally, there may be cases where your data will be transmitted to Siloanlagen Achberg Verwaltung GmbH for one of the reasons stated in para. 2 due to the division of work within the Siloanlagen Achberg group of companies.

The purpose of the transmission is to discharge work processes that occur as part of the pursuit of entrepreneurial objectives within a group of companies in a structured manner in accordance with our division of work and responsibilities; the legal basis for this transmission is Article 6(1)(f) GDPR.  

4.      Your rights

4.1    You have the following rights towards us regarding your personal data:

– the right to information, whether and which of your personal data are processed by us,
– the right to correction or deletion of your data,
– the right to limitation of processing,
– the right to object to the processing, if the legal basis of the processing is Article 6(1)(f) GDPR, and
– the right to data portability.

4.2    You also have the right to file a complaint with a data protection supervisory authority concerning our
 processing of your personal data.
